Terms and Conditions of Sale
These Terms and Conditions of Sale (the “Terms”) govern the sale of products (the “Products”) by LampLair (“we,” “us,” or “our”) to you through our website. Please read these Terms carefully before placing an order. By placing an order, you agree to be bound by these Terms.
- Scope and Conclusion of Contract
These Terms apply to all orders placed via our online platform. The presentation of Products on our website constitutes a non-binding invitation for you to submit a purchase offer. By submitting an order, you make a binding offer to purchase the selected Products. Order confirmation is sent automatically but does not constitute acceptance of your offer. The purchase contract is formed only when we expressly accept your order, typically by sending a separate acceptance confirmation or by dispatching the Product. - Customer Information and Account
You warrant that all information provided during registration and ordering is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials. Please inform us immediately of any unauthorized use of your account. - Prices and Payment Terms
All prices are final and include statutory value-added tax (VAT) where applicable. Shipping costs are not included in the product price and will be clearly displayed during checkout. Payment is due immediately upon order placement. We reserve the right to offer selected payment methods and may exclude certain methods depending on the order. - Delivery and Transfer of Risk
Delivery periods are estimates only and non-binding. Partial deliveries are permitted. The risk of loss or damage to the Products transfers to you upon handover to the carrier. - Reservation of Title
We retain full legal title to the Products until we have received full payment of the purchase price. - Right of Cancellation for Consumers
If you are a consumer, you have the right to cancel your order within fourteen days without giving any reason. The cancellation period expires fourteen days from the day you, or a third party you nominate, takes physical possession of the Products. To exercise your right, you must inform us of your decision to cancel by a clear statement. To meet the deadline, it is sufficient for you to send your communication before the cancellation period has expired. Please note that this right may be subject to specific exemptions for customized or made-to-order goods. - Returns and Consequences of Cancellation
If you cancel the contract, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event not later than fourteen days from the day we are informed of your cancellation. We may withhold reimbursement until we have received the Products back, or you have supplied evidence of having sent them back, whichever is earliest. You must return the Products to us without undue delay and in any event not later than fourteen days after communicating your cancellation. You are responsible for the direct cost of returning the Products. You are only liable for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products. - Warranty and Defects
We provide a warranty for the Products in accordance with applicable statutory provisions. Your legal rights regarding defective Products are not limited by these Terms. - Liability
Our liability for damages is limited to intent and gross negligence, except in cases of injury to life, body, or health, or under mandatory provisions of law. - Data Protection
We process your personal data in accordance with our Privacy Policy. - Final Provisions
We reserve the right to amend these Terms. Amendments will be communicated appropriately and apply to future orders. Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The law of our registered office shall apply, excluding its conflict of law rules and international conventions. For consumers, this choice of law applies only to the extent not overridden by mandatory provisions of the law of your country of residence.
